- Registration: All bidders must register online before placing a bid.
- Extended Bidding (Anti-Snipe): The auction features an automatic extension. If a bid is placed within the final 3 minutes of the scheduled closing time, the bidding period will automatically be extended by an additional 3 minutes to allow for counter-bids. This will continue until all bidding has ceased.
- Sale Subject to Confirmation: The property is being offered subject to the seller’s confirmation. The seller reserves the right to accept or reject the high bid.
Auction Terms and Conditions
By placing a bid, all bidders acknowledge and agree to the following terms:
- As-Is, Where-Is: The property is being sold “AS IS, WHERE IS” with no warranties, expressed or implied. Bidders are responsible for conducting all due diligence and inspections before bidding.
- Contingencies: The sale is NOT contingent upon the buyer’s ability to obtain financing, complete inspections, or receive an appraisal.
- Buyer’s Premium: A 10% Buyer’s Premium will be added to the high bid amount to determine the total contract purchase price. (Example: A $100,000 high bid + $10,000 Buyer’s Premium = $110,000 Contract Price).
- Earnest Money Deposit: The successful bidder will be required to place a 10% non-refundable Earnest Money Deposit of the contract price into escrow immediately following the auction (typically by the next business day).
- Possession: At the time of closing.
- Closing: Closing is expected to occur within 45 days from the auction date.
- Title and Taxes: Seller shall provide a marketable title. Taxes will be prorated to the date of closing.
- Minerals: SURFACE ONLY OFFERING. The sale is for the surface rights only; NO mineral rights will convey to the buyer.
