Terms & Conditions
By participating in any of our auctions, you hereby agree to all auction company terms and conditions, as applicable. Please read the terms carefully as they are a legal binding contract between you and Bellamy & Co. LLC.

Real Estate: 10% of the purchase price is to be placed in escrow the day of the auction with the balance being due upon delivery of merchantable title. Bidding is not contingent on the buyers ability to acquire financing, you must have all financing completed prior to bidding. Information is gathered from sources deemed to be reliable though is subject to inaccuracies or misinterpretations. Buyers are to satisfy themselves as to condition, including acreage, prior to bidding. Seller will not provide the survey; buyers will be responsible for the survey on the tracts they purchase. Taxes: Will be prorated to closing. Minerals: MAY be offered, if Seller chooses to do so. Any announcements made day of sale take precedence over any previously stated or published material. Sale may be subject to Seller confirmation and Buyers premium to establish the contract price.

Personal Property: Cash, Check, and Credit Card accepted with Proper ID. All items sold as is, where is, with no guarantees / warranties expressed or implied. Information is gathered from sources deemed reliable though is subject to inaccuracies or misrepresentations. Buyers are to satisfy themselves as to condition prior to bidding. Not responsible for accidents. Nothing is to be removed prior to be being paid for in full. Items are to be removed immediately following the close of the auction. Any items left are at the risk and responsibility of the buyer.
 
Personal Property Online Auction Terms: By participating in this auction, Buyers agree to the following terms. Please read the terms carefully as they are a legal binding contract between you and Bellamy & Co. LLC. All disputes will be settled in Alfalfa County Oklahoma. If purchases are not settled within 2 business days of the close of the auction, it is in default. Upon default the bidder will be black listed on Bellamy & Co. LLC auctions as well as MarkNet auctions and will be charged 25% of bid price or $500, whichever is greater, and the merchandise will be forfeited back to Bellamy & Co. LLC. Any items remaining after 10 days of the auction ending are considered forfeited and become property of Bellamy & Co. LLC. No refunds will be given. Any items remaining on sale site after pickup are subject to forfeit with no refund.

Firearms: All applicable gun laws will be observed. All buyers will fill out proper paperwork, show ID, and FBI background check will be performed before possession of firearm will be transferred to the buyer. If the buyer is unable to take possession of the firearm, a 25% restocking fee will be assessed. (If you cannot pass the background check, please do not bid on firearms). Handguns: Out of state residents must have handguns transferred to a FFL (Federal Firearm Licensee) in their state of residence and buyer must take possession from them. A shipping and handling fee will be assessed to send the handgun to the FFL.

Hold Harmless: Bidders /Buyers / Sellers agree to indemnify and save harmless Bellamy & Co. LLC, and/or their agents and employees, against any claims, actions, causes of action, demands, rights, damages, losses or costs that may be associated with participating in any Bellamy & Co. LLC auctions or events.  

Bellamy & Co. LLC reserves the right to add or remove items from the auction; split or combine lots; add minimum bids or reserve prices. The auctioneer reserves the right to cancel, suspend, extend or reschedule an individual item and or auction event or to make changes to the auction closing times or inspection or removal times.
